General Terms and Conditions & Privacy
1. Engagement and Execution of Mandate
The client engagement is entered into exclusively with Arven Juridik AB (hereinafter referred to as "the Firm") and not with any individual natural person. Multiple associates, partners, or external consultants retained by the Firm may collaborate on your matter.
The Firm reserves the right to decline an engagement or immediately withdraw from an ongoing matter in the event of a Conflict of Interest, non-payment of retainers or invoices, a material breakdown in mutual trust, or if the client in any other manner significantly obstructs the proper execution of the mandate.
Legal assessments, opinions, and advice provided by the Firm constitute professional evaluations based on the current state of law and do not, under any circumstances, imply a warranty or guarantee of a specific outcome or result.
2. Fees, Retainers, and Invoicing
Unless a fixed-fee arrangement has been expressly agreed upon, the Firm’s fees are calculated on a time-spent basis. All professional services rendered (including, but not limited to, telephone conferences, correspondence, meetings, legal analysis, and drafting of documentation) are billable per commenced quarter of an hour, subject to a minimum charge of one (1) hour per matter. Travel time shall be invoiced as billable time only if the total travel time for a single round-trip exceeds 30 minutes.
Invoicing is conducted on an ongoing monthly basis or upon completion of the mandate. Unless otherwise agreed, invoices are due and payable within 14 days of the invoice date. Late payments shall incur interest on arrears and statutory collection fees in accordance with applicable law.
3. Communication and Limitation of Liability
Primary correspondence shall be conducted via email, telephone, and video conferences. The client bears sole responsibility for ensuring that the Firm is provided with up-to-date contact information. The Firm disclaims all liability for any prejudice or loss of rights resulting from obsolete or incorrect client contact details.
Our advice is strictly tailored to the specific facts and circumstances of the individual mandate. The Firm accepts no liability for damages arising from the client's use of our work product or advice in any other context or for any purpose other than that for which it was originally rendered. The Firm shall not be held liable for errors, losses, or damages resulting from misleading, inaccurate, or incomplete information provided by the client or any third party. Furthermore, the Firm is exempt from liability for any failure, delay, or damage resulting from circumstances beyond its reasonable control, which could not have been foreseen or avoided.
We strive to consistently meet your professional expectations. Should you be dissatisfied with our services, please notify us immediately. Any formal malpractice or liability claim against the Firm must be submitted in writing within 12 months from the date on which you became aware, or reasonably should have become aware, of the grounds giving rise to the claim.
4. Confidentiality and Retention of Records
All personnel employed or retained by the Firm are bound by professional secrecy and duties of confidentiality. Information shall only be disclosed to third parties with your express consent, as a necessary measure to execute the mandate, in the context of a fee dispute, or pursuant to a mandatory statutory obligation (e.g., anti-money laundering legislation).
Relevant case files, documents, and personal data generated during the mandate shall be retained digitally or in hard copy for a minimum of ten (10) years following the closure of the file. All original documents shall be returned to the client upon final settlement of the matter.
